Personal injury lawsuits, also called “PI cases”, can take a variety of forms. Most such cases are handled on a “contingency fee” basis, meaning that the attorney’s fee will be paid only in the event of trial verdict or a settlement, and the fee will be a designated percentage of the amount of verdict or settlement.

Susan has also handled cases for clients who are “defendants” as they are being sued for accidents they are claimed to have caused. Susan has been hired by insurance companies and by individuals to help present the best possible defense. This can sometimes involve filing a counterclaim, cross-claim, or third-party claim, if there are others who are to blame for the injuries or losses.

One critical aspect of a personal injury case is the statute of limitations, or deadline, for filing suit. Each state is different, and many types of cases have different time deadlines. It is best to seek the advice of an attorney shortly after an accident to determine the appropriate deadline for filing a suit or claim. It will also be important to give prompt and accurate notice of the accident to the relevant insurance companies. Failure to do so could result in a loss of payment of benefits or coverage.
